Terms of service

These terms apply between DeSpoof and the account holder using the service. Creating an account means accepting them.

1. What the service does

DeSpoof provides an embeddable liveness check. When a visitor completes it, we return a single-use code, and your server exchanges that code for a result telling you whether a live person followed the prompts.

The service confirms presence, not identity. It does not tell you who the person was, whether they are who they claim to be, whether they are of a particular age, or whether they are acting for themselves. It is one signal among the ones you use, and it should not be the only control on a decision that matters.

2. Your account

• You are responsible for everything done through your account and your keys.
• Your secret key belongs on your server. Publishing it in a page, an app bundle or a repository is a breach of these terms, and any use that follows is yours.
• Tell us promptly if you believe a key has been exposed. You can replace it yourself at any time in the dashboard.
• One person or organisation per account. Do not share sign-in details.

3. Your obligations to your visitors

You are asking your visitors to turn on a camera, so these are yours to meet, not ours.

• Have a lawful basis for asking, wherever your visitors are.
• Say what happens in your own privacy policy, and keep the consent wording in the widget accurate.
• Offer a workable alternative for anyone who has no camera, refuses permission, or cannot complete the check. Nobody should be locked out of your service because of this.
• Do not use the service on people you know to be children where the law where they are does not allow it.
• Do not present the check as identity verification, age verification, or proof of anything it does not establish.

4. Acceptable use

You may not use the service to:

• Attempt to identify, track, profile or match individuals, or combine our results with other data for that purpose
• Run checks on people without their knowledge, or on a page designed to obscure that a camera is opening
• Deploy the widget on a website you have not approved in your dashboard, or on one you do not control
• Reverse engineer, probe or interfere with the check itself, or attempt to produce a passing result without a person present
• Resell access, or place the service behind your own API for third parties, without a written agreement with us
• Break any law, or facilitate anything unlawful

We may suspend an account that is doing any of these, and we will tell you why.

5. Plans, allowances and payment

• Each plan includes a number of successful checks per calendar month, in UTC.
• Only checks that passed count. Failed attempts, attempts stopped by your own throttling, and attempts refused because the website was not approved are free.
• Fees are charged in advance and are not refundable in part, except where the law requires it.
• We will email you when you approach your allowance. We do not switch the service off mid-month without contacting you first.
• We may change pricing with 30 days' notice, taking effect at your next renewal.

6. Availability

We aim to keep the service running continuously, and we do not promise it will be. Maintenance, faults and events outside our control can interrupt it. Build your own flow so that an unavailable check does not break your site: decide in advance whether the action waits, falls back, or proceeds with a flag.

7. Your data

The privacy policy explains what is collected and kept. In short: no camera image is stored at any point, and the record of a check is the time, the connection, the browser, the prompts and the result.

You may export or delete your account data at any time. Deleting a website removes its settings and its history and cannot be undone.

8. Our intellectual property

The service, the widget, the dashboard and everything in them remain ours. You get a non-exclusive, non-transferable right to use them on the websites you have approved, for as long as your account is open.

9. No warranty

The service is provided as it is. We do not warrant that it will detect every attempt to fake presence, that it will never fail a genuine person, or that it will be free of faults. Liveness detection raises the cost of automated abuse. It does not eliminate it, and we say so plainly rather than in a footnote.

10. Liability

To the extent the law allows, neither party is liable for indirect or consequential loss, lost profits, lost revenue or lost data. Our total liability in any twelve month period is limited to the fees you paid us in that period.

Nothing in these terms excludes any right or guarantee that cannot lawfully be excluded, including under the Australian Consumer Law.

11. Indemnity

You will cover us against claims arising from your use of the service in breach of section 3 or section 4, including claims by your own visitors about how or why the check was presented to them.

12. Ending the agreement

You can close your account at any time from the dashboard. We can end or suspend an account for a breach of these terms, for non-payment, or if we stop offering the service, with reasonable notice except where a breach requires immediate action.

13. Changes to these terms

We may update these terms. Material changes will be posted here and emailed to account holders at least 14 days before they take effect. Continuing to use the service after that means accepting them.

14. Governing law

These terms are governed by the laws of New South Wales, Australia, and both parties submit to the courts of that state.
